Copyright Policy

Brief Productivity Solutions, Inc. ("Brief," "we," "us," or "our") respects the intellectual property rights of others and expects users of the Brief service (the "Service") to do the same. This Copyright Policy explains how to report material you believe infringes your copyright, how to respond if your material is removed, and Brief's policy on repeat infringers. It supplements, and is incorporated into, Brief's Terms of Service.

If you believe that material available through the Service infringes a copyright you own or are authorized to act for, you may send a written notice of claimed infringement to Brief's Designated Copyright Agent, identified in Section 2. To be effective under the Digital Millennium Copyright Act (the "DMCA," 17 U.S.C. § 512(c)(3)), your notice must include all of the following:

  • (a) a physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf;
  • (b) identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of those works;
  • (c) identification of the material that is claimed to be infringing and that is to be removed or disabled, and information reasonably sufficient to permit Brief to locate the material, such as the account, URL, or a description of where it appears;
  • (d) your contact information, including your name, mailing address, telephone number, and email address;
  • (e) a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  • (f) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

3. Removal of Infringing Material

Upon receiving a notice that substantially complies with Section 1, Brief will act expeditiously to remove or disable access to the material claimed to be infringing, and may notify the user responsible for the material that it has been removed or disabled.

4. Counter-Notification

If your material was removed or disabled and you believe the removal was the result of a mistake or misidentification, you may submit a written counter-notification to the Designated Copyright Agent in Section 2. To be effective under 17 U.S.C. § 512(g)(3), your counter-notification must include all of the following:

  • (a) your physical or electronic signature;
  • (b) identification of the material that was removed or disabled, and the location at which the material appeared before it was removed or disabled;
  • (c) a statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; and
  • (d) your name, mailing address, and telephone number, together with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which Brief may be found, and that you will accept service of process from the person who submitted the original notice of claimed infringement, or that person's agent.

After Brief receives a valid counter-notification, it will forward a copy to the person who submitted the original notice. Brief may restore the removed material in not less than ten, nor more than fourteen, business days following receipt of the counter-notification, unless the original complainant first notifies the Designated Copyright Agent that it has filed an action seeking a court order to restrain the allegedly infringing activity.

5. Repeat Infringers

In accordance with the DMCA and Brief's Terms of Service, Brief will, in appropriate circumstances and in its discretion, disable or terminate the accounts of users who are determined to be repeat infringers of the copyright rights of others.

6. Changes to This Policy
